HonestGun.com is an independent, informational resource for first-time firearm buyers. We are not a licensed firearms dealer (FFL), a law firm, a government agency, or affiliated with the ATF or any state licensing body. See our Disclaimer for more on what that means for the content on this Site.
2. Use of the Site
You may use the Site for lawful, personal, non-commercial purposes. You agree not to:
- Use the Site in any way that violates applicable federal, state, or local law — including laws governing the purchase, sale, transfer, or possession of firearms
- Use the Site to facilitate a private firearm sale or transfer that would be illegal in the relevant jurisdiction
- Scrape, copy, or republish our content without permission (see Section 3)
- Interfere with the Site’s operation, security, or availability
- Impersonate any person or entity, or misrepresent your affiliation with anyone
- Use the Site to harass, threaten, or harm others
We may suspend or terminate your access to the Site at any time, for any reason, including violation of these Terms.
3. Intellectual Property
All content on the Site — articles, guides, graphics, logos, and the “HonestGun.com” name and branding — is owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws, unless otherwise noted.
You may share links to our content and quote brief excerpts with attribution and a link back to the original page. You may not republish, redistribute, or create derivative works from our content without our prior written permission.
If you believe content on the Site infringes your copyright, contact us at the address in Section 11 with details of the claim.
4. User Contributions
We may allow comments or other user-submitted content on the Site in the future. If we do, by submitting a comment or other content you confirm it’s your own original content, grant us a non-exclusive, royalty-free, worldwide license to display it, and agree it will not contain anything unlawful, threatening, harassing, defamatory, or that facilitates an illegal firearm transaction. We may remove or moderate any user content at our discretion.
5. Affiliate Links & Third-Party Content
The Site contains affiliate links and links to third-party sites, dealers, manufacturers, and services. We don’t control those third parties and aren’t responsible for their content, products, services, availability, or privacy practices.

Nothing on the Site constitutes legal, safety, medical, or professional advice. See our full Disclaimer for details. Firearm laws vary by state and change over time — always verify current requirements with an official source before acting.
7. Disclaimer of Warranties
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT ANY INFORMATION ON THE SITE IS CURRENT, COMPLETE, OR ACCURATE FOR YOUR SITUATION — PARTICULARLY REGARDING STATE-SPECIFIC FIREARM LAWS, WHICH CHANGE FREQUENTLY.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, HONESTGUN.COM AND ITS OWNER(S) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SITE OR RELIANCE ON ANY CONTENT ON THE SITE — INCLUDING, WITHOUT LIMITATION, ANY DECISION RELATED TO PURCHASING, STORING, OR HANDLING A FIREARM. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE WILL NOT EXCEED $100.
Some jurisdictions don’t allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
9. Indemnification
You agree to indemnify and hold harmless HonestGun.com and its owner(s) from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your misuse of the Site, or your violation of any law or third-party right.
10. Binding Arbitration & Class Action Waiver
Please read this section carefully — it affects your legal rights.
You and HonestGun.com agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site will be resolved by binding individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies.
- No class actions. You and HonestGun.com agree that any arbitration or proceeding will be conducted only on an individual basis and not as a class, consolidated, or representative action.
- Arbitration rules. Arbitration will be administered by a recognized arbitration provider (e.g., the American Arbitration Association) under its consumer arbitration rules then in effect, and will take place in, or be governed by the law of, the state identified in Section 12.
- Opt-out. You may opt out of this arbitration agreement by emailing us at the address in Section 11 within 30 days of first using the Site, stating that you decline to be bound by it.
- Severability. If the class action waiver is found unenforceable as to a particular claim, that claim may proceed in court, while the rest of this section remains in effect.

12. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws principles, except where the Federal Arbitration Act applies to Section 10. Subject to Section 10, any dispute not covered by arbitration will be brought exclusively in the state or federal courts located in Colorado, and you consent to that jurisdiction.
13. Changes to These Terms
We may update these Terms from time to time. We’ll update the “Effective Date” below when we do. Continuing to use the Site after changes take effect means you accept the updated Terms.
14. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect. These Terms, along with our Privacy Policy and Disclaimer, make up the entire agreement between you and HonestGun.com regarding use of the Site.
